Voter Initiative Petition Process for Charter Amendments and Ordinances

Voters’ Right to Initiate County Ordinances by the Petition Process

Brevard County residents are permitted by Section 5.1 of the County Charter to propose County ordinances in order to:

  • establish new legislation that is not in conflict with the State Constitution, general law or the County Charter, and to,
  • amend or repeal existing ordinances when such amendments or repeal are not in conflict with the State Constitution or general law

The initiative process requires a petition signed by a number at least equal to five percent (5%) of electors qualified to vote in the last preceding general election; provided that the number contains at least five percent (5%) of the qualified electors in each of at least three Commission election districts.

Voters’ Right to Amend the County Charter by the Petition Process

Brevard County residents are permitted to propose amendments to the County Charter under Section 7.3 of the County Charter.

The amendment process requires a petition signed by at least four percent (4%) of the electors from each County Commission District.

The cost to verify Initiative Petitions in Brevard County is $0.95 per petition, as of February 2, 2024. Per F.S. 100.371, this cost will be adjusted as needed.
